Introduction

We are very delighted that you have shown interest in our institution. Data protection is of a particularly high priority for the management of NBS Northern Business School gGmbH. The use of the websites of NBS Northern Business School gGmbH is generally possible without any indication of personal data. However, if a data subject wishes to use special services of our institution via our website, processing of personal data could become necessary. If the processing of personal data is necessary and there is no statutory basis for such processing, we generally obtain consent from the data subject.

The processing of personal data, such as the name, address, e-mail address or telephone number of a data subject, shall always be in line with the General Data Protection Regulation (GDPR) and in accordance with the country-specific data protection regulations applicable to NBS Northern Business School gGmbH. By means of this privacy policy, our institution would like to inform the general public of the nature, scope and purpose of the personal data we collect, use and process. Furthermore, data subjects are informed, by means of this privacy policy, of the rights to which they are entitled.

As the controller, NBS Northern Business School gGmbH has implemented numerous technical and organisational measures to ensure the most complete protection of personal data processed through this website. However, Internet-based data transmissions may in principle have security gaps, so absolute protection cannot be guaranteed. For this reason, every data subject is free to transfer personal data to us via alternative means, e.g. by telephone.

Personal data means any information relating to an identified or identifiable natural person (hereinafter "data subject"). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

b) Data subject

Data subject is any identified or identifiable natural person whose personal data is processed by the controller responsible for the processing.

d) Restriction of processing

Restriction of processing is the marking of stored personal data with the aim of limiting their processing in the future.

e) Profiling

Profiling means any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict aspects concerning that natural person's performance at work, economic situation, health, personal preferences, interests, reliability, behaviour, location or movements.

f) Pseudonymisation

Pseudonymisation is the processing of personal data in such a manner that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organisational measures to ensure that the personal data are not attributed to an identified or identifiable natural person.

g) Controller or controller responsible for the processing

Controller or controller responsible for the processing is the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law.

However, public authorities which may receive personal data in the framework of a particular inquiry in accordance with Union or Member State law shall not be regarded as recipients.

j) Third party

Third party is a natural or legal person, public authority, agency or body other than the data subject, controller, processor and persons who, under the direct authority of the controller or processor, are authorised to process personal data.

k) Consent

Consent of the data subject is any freely given, specific, informed and unambiguous indication of the data subject's wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.

Cookies

The websites of NBS Northern Business School gGmbH use cookies. Cookies are text files that are stored on a computer system via an Internet browser.

Many Internet sites and servers use cookies. Many cookies contain a so-called cookie ID. A cookie ID is a unique identifier of the cookie. It consists of a character string through which Internet pages and servers can be assigned to the specific Internet browser in which the cookie was stored. This allows visited Internet sites and servers to differentiate the individual browser of the data subject from other Internet browsers that contain other cookies. A specific Internet browser can be recognised and identified using the unique cookie ID.

Through the use of cookies, NBS Northern Business School gGmbH can provide the users of this website with more user-friendly services that would not be possible without the cookie setting.

By means of a cookie, the information and offers on our website can be optimised with the user in mind. As already mentioned, cookies allow us to recognise our website users. The purpose of this recognition is to make it easier for users to utilise our website. For example, the user of a website that uses cookies does not have to enter access data each time the website is accessed, because this is taken over by the website and the cookie stored on the user's computer system. Another example is the cookie of a shopping cart in an online shop. The online shop remembers the articles that a customer has placed in the virtual shopping cart via a cookie.

The data subject may, at any time, prevent the setting of cookies through our website by means of a corresponding setting of the Internet browser used, and may thus permanently object to the setting of cookies. Furthermore, already set cookies may be deleted at any time via an Internet browser or other software programs. This is possible in all popular Internet browsers. If the data subject deactivates the setting of cookies in the Internet browser used, not all functions of our website may be entirely usable.

Collection of general data and information

The website of NBS Northern Business School gGmbH collects a series of general data and information when a data subject or automated system calls up the website. This general data and information are stored in the server log files. The following may be collected: (1) the browser types and versions used, (2) the operating system used by the accessing system, (3) the website from which an accessing system reaches our website (so-called referrer), (4) the sub-websites accessed via an accessing system on our website, (5) the date and time of access to the website, (6) an Internet Protocol address (IP address), (7) the Internet service provider of the accessing system, and (8) any other similar data and information that serve to avert danger in the event of attacks on our information technology systems.

When using this general data and information, NBS Northern Business School gGmbH does not draw any conclusions about the data subject. Rather, this information is needed to (1) deliver the content of our website correctly, (2) optimise the content of our website as well as its advertisement, (3) ensure the long-term viability of our information technology systems and website technology, and (4) provide law enforcement authorities with the information necessary for criminal prosecution in case of a cyber-attack. Therefore, NBS Northern Business School gGmbH analyses anonymously collected data and information statistically, with the aim of increasing the data protection and data security of our institution, and to ensure an optimal level of protection for the personal data we process. The anonymous data of the server log files are stored separately from all personal data provided by a data subject.

Contact options via the website

Due to legal requirements, the website of NBS Northern Business School gGmbH contains information that enables quick electronic contact with our institution as well as direct communication with us, which also includes a general address for so-called electronic mail (e-mail address). If a data subject contacts the controller by e-mail or via a contact form, the personal data transmitted by the data subject are automatically stored. Such personal data transmitted on a voluntary basis by a data subject to the controller are stored for the purpose of processing or contacting the data subject. These personal data are not passed on to third parties.

Routine erasure and blocking of personal data

The controller processes and stores the personal data of the data subject only for the period necessary to achieve the purpose of storage, or as far as this is provided for by the European legislator or other legislators in laws or regulations to which the controller is subject.

If the storage purpose no longer applies, or if a storage period prescribed by the European legislator or another competent legislator expires, the personal data are routinely blocked or erased in accordance with legal requirements.

If a data subject wishes to avail himself or herself of this right of confirmation, he or she may, at any time, contact any employee of the controller.

b) Right of access

Each data subject affected by the processing of personal data shall have the right granted by the European legislator to obtain from the controller, at any time and free of charge, information about the personal data stored about him or her and a copy of this information. Furthermore, the European legislator has granted the data subject access to the following information:

  • the purposes of the processing
  • the categories of personal data concerned
  • the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organisations
  • where possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period
  • the existence of the right to request from the controller rectification or erasure of personal data, or restriction of processing of personal data concerning the data subject, or to object to such processing
  • the existence of the right to lodge a complaint with a supervisory authority
  • where the personal data are not collected from the data subject: any available information as to their source
  • the existence of automated decision-making, including profiling, referred to in Article 22(1) and (4) GDPR and, at least in those cases, meaningful information about the logic involved, as well as the significance and envisaged consequences of such processing for the data subject

Furthermore, the data subject shall have a right to obtain information as to whether personal data are transferred to a third country or to an international organisation. Where this is the case, the data subject shall have the right to be informed of the appropriate safeguards relating to the transfer.

If a data subject wishes to avail himself or herself of this right of access, he or she may, at any time, contact any employee of the controller.

c) Right to rectification

Each data subject affected by the processing of personal data shall have the right granted by the European legislator to obtain from the controller without undue delay the rectification of inaccurate personal data concerning him or her. Taking into account the purposes of the processing, the data subject shall have the right to have incomplete personal data completed, including by means of providing a supplementary statement.

If a data subject wishes to exercise this right to rectification, he or she may, at any time, contact any employee of the controller.

d) Right to erasure (right to be forgotten)

Each data subject affected by the processing of personal data shall have the right granted by the European legislator to obtain from the controller the erasure of personal data concerning him or her without undue delay, where one of the following grounds applies, as long as the processing is not necessary:

  • The personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed.
  • The data subject withdraws consent on which the processing is based according to Article 6(1)(a) GDPR or Article 9(2)(a) GDPR, and where there is no other legal ground for the processing.
  • The data subject objects to the processing pursuant to Article 21(1) GDPR and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing pursuant to Article 21(2) GDPR.
  • The personal data have been unlawfully processed.
  • The personal data must be erased for compliance with a legal obligation in Union or Member State law to which the controller is subject.
  • The personal data have been collected in relation to the offer of information society services referred to in Article 8(1) GDPR.

If one of the aforementioned reasons applies, and a data subject wishes to request the erasure of personal data stored by NBS Northern Business School gGmbH, he or she may, at any time, contact any employee of the controller. An employee of NBS Northern Business School gGmbH shall promptly ensure that the erasure request is complied with immediately.

Where NBS Northern Business School gGmbH has made the personal data public and is obliged, as the controller, pursuant to Article 17(1) GDPR to erase the personal data, NBS Northern Business School gGmbH, taking account of available technology and the cost of implementation, shall take reasonable steps, including technical measures, to inform other controllers processing the published personal data that the data subject has requested erasure by such controllers of any links to, or copies or replications of, those personal data, as far as processing is not required. An employee of NBS Northern Business School gGmbH will arrange the necessary measures in individual cases.

e) Right to restriction of processing

Each data subject affected by the processing of personal data shall have the right granted by the European legislator to obtain from the controller restriction of processing where one of the following applies:

  • The accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data.
  • The processing is unlawful and the data subject opposes the erasure of the personal data and requests instead the restriction of their use.
  • The controller no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defence of legal claims.
  • The data subject has objected to processing pursuant to Article 21(1) GDPR pending the verification whether the legitimate grounds of the controller override those of the data subject.

If one of the aforementioned conditions is met, and a data subject wishes to request the restriction of the processing of personal data stored by NBS Northern Business School gGmbH, he or she may, at any time, contact any employee of the controller. The employee of NBS Northern Business School gGmbH will arrange the restriction of the processing.

f) Right to data portability

Each data subject affected by the processing of personal data shall have the right granted by the European legislator to receive the personal data concerning him or her, which he or she has provided to a controller, in a structured, commonly used and machine-readable format. He or she shall have the right to transmit those data to another controller without hindrance from the controller to which the personal data have been provided, as long as the processing is based on consent pursuant to Article 6(1)(a) GDPR or Article 9(2)(a) GDPR, or on a contract pursuant to Article 6(1)(b) GDPR, and the processing is carried out by automated means, as long as the processing is not necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

Furthermore, in exercising his or her right to data portability pursuant to Article 20(1) GDPR, the data subject shall have the right to have personal data transmitted directly from one controller to another, where technically feasible and when doing so does not adversely affect the rights and freedoms of others.

In order to assert the right to data portability, the data subject may at any time contact any employee of NBS Northern Business School gGmbH.

g) Right to object

Each data subject affected by the processing of personal data shall have the right granted by the European legislator to object, on grounds relating to his or her particular situation, at any time, to processing of personal data concerning him or her which is based on Article 6(1)(e) or (f) GDPR. This also applies to profiling based on these provisions.

In the event of an objection, NBS Northern Business School gGmbH shall no longer process the personal data, unless we can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or the processing serves the establishment, exercise or defence of legal claims.

If NBS Northern Business School gGmbH processes personal data for direct marketing purposes, the data subject shall have the right to object at any time to processing of personal data concerning him or her for such marketing. This also applies to profiling to the extent that it is related to such direct marketing. If the data subject objects to NBS Northern Business School gGmbH to the processing for direct marketing purposes, NBS Northern Business School gGmbH will no longer process the personal data for these purposes.

In addition, the data subject has the right, on grounds relating to his or her particular situation, to object to processing of personal data concerning him or her by NBS Northern Business School gGmbH for scientific or historical research purposes, or for statistical purposes pursuant to Article 89(1) GDPR, unless the processing is necessary for the performance of a task carried out for reasons of public interest.

In order to exercise the right to object, the data subject may directly contact any employee of NBS Northern Business School gGmbH or another employee. In addition, the data subject is free in the context of the use of information society services, and notwithstanding Directive 2002/58/EC, to exercise his or her right to object by automated means using technical specifications.

h) Automated individual decision-making, including profiling

Each data subject affected by the processing of personal data shall have the right granted by the European legislator not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning him or her, or similarly significantly affects him or her, as long as the decision (1) is not necessary for entering into, or the performance of, a contract between the data subject and the controller, or (2) is not authorised by Union or Member State law to which the controller is subject and which also lays down suitable measures to safeguard the data subject's rights and freedoms and legitimate interests, or (3) is not based on the data subject's explicit consent.

If the decision (1) is necessary for entering into, or the performance of, a contract between the data subject and the controller, or (2) is based on the data subject's explicit consent, NBS Northern Business School gGmbH shall implement suitable measures to safeguard the data subject's rights and freedoms and legitimate interests, at least the right to obtain human intervention on the part of the controller, to express his or her point of view and to contest the decision.

If the data subject wishes to exercise the rights concerning automated individual decision-making, he or she may, at any time, contact any employee of the controller.

i) Right to withdraw data protection consent

Each data subject affected by the processing of personal data shall have the right granted by the European legislator to withdraw his or her consent to the processing of personal data at any time.

If the data subject wishes to exercise the right to withdraw consent, he or she may, at any time, contact any employee of the controller.

Data protection in applications and the application procedure

The controller collects and processes the personal data of applicants for the purpose of handling the application procedure. The processing may also be carried out electronically. This is in particular the case if an applicant submits corresponding application documents electronically, for example by e-mail or via a web form on the website, to the controller. If the controller concludes an employment contract with an applicant, the submitted data will be stored for the purpose of processing the employment relationship in compliance with legal requirements. If the controller does not conclude an employment contract with the applicant, the application documents are automatically erased, or their erasure is initiated and documented, two months after notification of the rejection decision, provided that no other legitimate interests of the controller are opposed to the erasure. Other legitimate interest in this sense is, for example, a burden of proof in proceedings under the German General Equal Treatment Act (Allgemeines Gleichbehandlungsgesetz, AGG).

Data protection provisions about the application and use of Google Analytics

On this website, the controller has integrated the component Google Analytics. Google Analytics is a web analytics service. Web analytics is the collection, gathering and analysis of data about the behaviour of visitors to websites. A web analytics service collects, inter alia, data about the website from which a data subject came to a website (so-called referrer), which sub-pages were visited, or how often and for what duration a sub-page was viewed. Web analytics are mainly used for the optimisation of a website and for the cost-benefit analysis of Internet advertising.

The provider of Google Analytics for users in the European Economic Area and Switzerland is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Its parent company is Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

We use Google Analytics 4. In Google Analytics 4, IP addresses of users in the EU are neither logged nor stored: Google merely derives the approximate location from the IP address on servers in the EU and then deletes it immediately.

The purpose of the Google Analytics component is to analyse the traffic on our website. Google uses the collected data and information, inter alia, to evaluate the use of our website and to compile online reports for us that show the activities on our websites, and to provide other services relating to the use of our website.

Google Analytics places cookies on the information technology system of the data subject. What cookies are has already been explained above. The cookies enable Google to analyse the use of our website. With each call-up of one of the individual pages of this website into which a Google Analytics component was integrated, the Internet browser on the information technology system of the data subject is automatically prompted by the respective Google Analytics component to transmit data to Google for the purpose of online analysis. As part of this technical procedure, Google gains knowledge of personal data such as online identifiers (e.g. cookie IDs) as well as device and browser information. As described above, the IP address is only used to determine the location and is not stored.

The cookies are used to store information such as the access time, the approximate location from which the access was made, and the frequency of visits to our website by the data subject. A transfer of these data to Google LLC in the USA cannot be ruled out. Google LLC is certified under the EU-US Data Privacy Framework (adequacy decision of the European Commission, Art. 45 GDPR). Google may pass these data collected through the technical procedure on to third parties.

Google Analytics is only used with your consent, which you give via our cookie banner (Art. 6(1)(a) GDPR, Section 25(1) of the German Telecommunications Digital Services Data Protection Act, TDDDG). You can withdraw your consent at any time with effect for the future via the cookie settings.

The data subject may, as stated above, prevent the setting of cookies through our website at any time by means of a corresponding setting of the Internet browser used and thus permanently object to the setting of cookies. Such a setting of the Internet browser used would also prevent Google from setting a cookie on the information technology system of the data subject. In addition, cookies already set by Google Analytics may be deleted at any time via the Internet browser or other software programs.

In addition, the data subject has the possibility of objecting to the collection of data generated by Google Analytics relating to the use of this website, as well as to the processing of these data by Google, and of preventing such processing. For this purpose, the data subject must download and install a browser add-on under the link https://tools.google.com/dlpage/gaoptout. This browser add-on tells Google Analytics, through JavaScript, that no data and information about visits to websites may be transmitted to Google Analytics. The installation of the browser add-on is considered an objection by Google. If the information technology system of the data subject is later deleted, formatted or newly installed, the data subject must reinstall the browser add-on to disable Google Analytics. If the browser add-on was uninstalled or deactivated by the data subject or another person within his or her sphere of control, it is possible to reinstall or reactivate the browser add-on.

Further information and the applicable data protection provisions of Google may be retrieved under https://policies.google.com/privacy?hl=en and under https://marketingplatform.google.com/about/analytics/terms/us/. Google Analytics is further explained under the following link: https://marketingplatform.google.com/about/analytics/.

Data protection provisions about the application and use of Google Ads

On this website, the controller has integrated Google Ads. Google Ads is an Internet advertising service that allows advertisers to place ads in Google search engine results as well as in the Google advertising network. Google Ads allows an advertiser to pre-define specific keywords with the help of which an ad is displayed in Google's search results only when the user retrieves a keyword-relevant search result with the search engine. In the Google advertising network, the ads are distributed on relevant websites using an automatic algorithm, taking into account the previously defined keywords.

The provider of Google Ads for users in the European Economic Area and Switzerland is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Its parent company is Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

The purpose of Google Ads is the promotion of our website by the display of interest-relevant advertising on the websites of third-party companies and in the search engine results of the Google search engine, and the display of third-party advertising on our website.

If a data subject reaches our website via a Google ad, a so-called conversion cookie is filed on the information technology system of the data subject by Google. What cookies are has already been explained above. A conversion cookie loses its validity after thirty days and is not used to identify the data subject. If the cookie has not expired, the conversion cookie is used to check whether certain sub-pages, e.g. the shopping cart of an online shop system, were called up on our website. Through the conversion cookie, both Google and the controller can understand whether a data subject who reached our website via a Google Ads ad generated sales, that is, executed or cancelled a sale of goods.

The data and information collected through the use of the conversion cookie are used by Google to create visit statistics for our website. These visit statistics are in turn used by us to determine the total number of users who have been referred to us via Ads ads, i.e. to ascertain the success or failure of each Ads ad and to optimise our Ads ads in the future. Neither our institution nor other Google Ads advertisers receive information from Google that could identify the data subject.

The conversion cookie stores personal information, e.g. the websites visited by the data subject. Each time we visit our websites, personal data, including the IP address of the Internet connection used by the data subject, are therefore transmitted to Google; a transfer to Google LLC in the USA cannot be ruled out. Google LLC is certified under the EU-US Data Privacy Framework (adequacy decision of the European Commission, Art. 45 GDPR). Google may pass these personal data collected through the technical procedure on to third parties.

Google Ads is only used with your consent, which you give via our cookie banner (Art.

Such a setting of the Internet browser used would also prevent Google from placing a conversion cookie on the information technology system of the data subject. In addition, a cookie already set by Google Ads may be deleted at any time via the Internet browser or other software programs.

The data subject also has the possibility of objecting to interest-based advertising by Google. For this purpose, the data subject must call up the link myadcenter.google.com from each of the browsers used and make the desired settings there.

Further information and the applicable data protection provisions of Google may be retrieved under https://policies.google.com/privacy?hl=en.

Data protection provisions about the application and use of Google Tag Manager

This website uses Google Tag Manager. This service allows website tags to be integrated and managed. Google Tag Manager itself does not set any cookies, only tags, and does not collect any personal data. Google Tag Manager triggers tags which, in turn, may collect data. However, Google Tag Manager does not access this data. If deactivation has been carried out at domain or cookie level, it remains in place for all tracking tags that may be implemented with Google Tag Manager.

The provider of Google Tag Manager for users in the European Economic Area and Switzerland is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Its parent company is Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

Data protection provisions about the application and use of YouTube

On this website, the controller has integrated components of YouTube. YouTube is an Internet video portal that enables video publishers to post video clips free of charge and other users to view, rate and comment on them, also free of charge. YouTube allows the publication of all kinds of videos, so that complete film and television programmes, as well as music videos, trailers and videos made by users themselves, can be accessed via the Internet portal.

The provider of YouTube for users in the European Economic Area and Switzerland is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Its parent company is Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. A transfer of data to Google LLC in the USA cannot be ruled out; Google LLC is certified under the EU-US Data Privacy Framework (adequacy decision of the European Commission, Art. 45 GDPR).

With each call-up of one of the individual pages of this website, which is operated by the controller and on which a YouTube component (YouTube video) was integrated, the Internet browser on the information technology system of the data subject is automatically prompted by the respective YouTube component to download a display of the corresponding YouTube component from YouTube. Further information about YouTube may be obtained under https://about.youtube/. As part of this technical procedure, YouTube and Google gain knowledge of which specific sub-page of our website was visited by the data subject.

If the data subject is logged in to YouTube at the same time, YouTube recognises, with each call-up of a sub-page that contains a YouTube video, which specific sub-page of our website the data subject visits. This information is collected by YouTube and Google and assigned to the respective YouTube account of the data subject.

YouTube and Google receive information through the YouTube component that the data subject has visited our website whenever the data subject is logged in to YouTube at the time of the call-up of our website; this occurs regardless of whether the data subject clicks on a YouTube video or not. If such a transmission of this information to YouTube and Google is not desired by the data subject, he or she can prevent it by logging out of his or her YouTube account before calling up our website.

The data protection provisions published by YouTube, which may be accessed under https://policies.google.com/privacy?hl=en, provide information about the collection, processing and use of personal data by YouTube and Google.

Data protection provisions about the application and use of Microsoft 365

On this website, the controller has integrated components of Microsoft 365. Microsoft 365 is a multilingual cloud service that is only accessible via individual personal access with a user name and password. Microsoft 365 comprises an online office suite for the use of office applications such as Microsoft Outlook, Microsoft Word, Microsoft Excel and Microsoft PowerPoint. Further components of Microsoft 365 include the cloud storage Microsoft OneDrive, in which users can store their own files and documents online. It is possible to share these files and documents with other users of Microsoft OneDrive. With the help of sharing links, files and documents can also be shared with external users. This requires active sharing by the Microsoft OneDrive user. Another service of Microsoft 365 is Microsoft Teams. This service enables several users to work on files and documents simultaneously and collaboratively. A prerequisite for using Microsoft Teams is that all users are registered in the same domain and thus belong to the same organisation. Linking Microsoft Teams with Microsoft SharePoint makes it possible to share the content developed in Microsoft Teams with external users as well and thus to reach a wider audience. This requires active sharing by the Microsoft 365 user.

The provider of Microsoft 365 for customers in the European Economic Area is Microsoft Ireland Operations Limited, One Microsoft Place, South County Business Park, Leopardstown, Dublin 18, Ireland. Its parent company is Microsoft Corporation, One Microsoft Way, Redmond, WA 98052, USA. Microsoft Corporation is certified under the EU-US Data Privacy Framework (adequacy decision of the European Commission, Art. 45 GDPR).

With each call-up of one of the individual pages of this website, which is operated by the controller and on which a Microsoft 365 component (Microsoft 365 button, Microsoft OneDrive) was integrated, the Internet browser on the information technology system of the data subject is automatically prompted by the respective Microsoft 365 component to download a display of the corresponding Microsoft 365 component from Microsoft 365. The purpose of integrating the Microsoft 365 component is to enable our users to be forwarded to Microsoft 365 in order to transfer product data from the respective user's product pool into the respective user's Microsoft OneDrive for Business via the self-developed automated data delivery service. Furthermore, the forwarding to Microsoft 365 is intended to enable the user to access the above-mentioned Microsoft 365 services quickly and easily in order to use them for his or her daily work and/or for collaboration with Northern Business School gGmbH.

If the data subject clicks on one of the Microsoft 365 buttons integrated on our website, the data and information transmitted are assigned to the personal Microsoft 365 user account of the data subject and stored and processed by Microsoft 365. This requires that the data subject is logged in to Microsoft 365 at the same time. Microsoft 365 receives information through the Microsoft 365 component that the data subject has visited our website whenever the data subject is logged in to Microsoft 365 at the time of the call-up of our website; this occurs regardless of whether the data subject clicks on the Microsoft 365 component or not. If such a transmission of this information to Microsoft 365 is not desired by the data subject, he or she can prevent it by logging out of his or her Microsoft 365 account before calling up our website.

The applicable data protection provisions of Microsoft 365 may be accessed under privacy.microsoft.com/en-us/privacystatement.

Data protection information for participation in events via Microsoft Teams

a) What data we process, for what purposes we process your data, and on what legal basis

We use a "conference tool" (hereinafter "service") to conduct telephone conferences, online meetings, video conferences and/or lectures/information events (hereinafter: "online meetings") and, where applicable, to record them (with the exception of telephone conferences).

"Microsoft Teams" is a Microsoft service. The contractual partner for customers in the European Economic Area is Microsoft Ireland Operations Limited, One Microsoft Place, South County Business Park, Leopardstown, Dublin 18, Ireland. Its parent company is Microsoft Corporation, One Microsoft Way, Redmond, WA 98052, USA. Various types of data are processed when using the service. The scope of the data also depends on the data you provide before or during participation in an "online meeting".

If necessary for the purpose of recording the results of an online meeting, we reserve the right to log the chat content.

No automated decision-making within the meaning of Art. 22 GDPR takes place.

The following personal/personally identifiable data are subject to processing when conducting "online meetings":

  • User details: e.g. surname, first name, display name, e-mail address if applicable, profile picture (optional), preferred language setting
  • Meeting metadata: e.g. date, time, meeting ID, telephone numbers, location, topic, description, duration of participation
  • Text, audio and video data: You may have the option of using the chat function in an "online meeting". In this case, the text entries you make are processed in order to display them in the "online meeting". In order to enable the display of video and the playback of audio, the data from the microphone of your device and from any video camera of the device are processed accordingly for the duration of the meeting.

The following personal/personally identifiable data are subject to processing when organising "online meetings":

  • User details and, where applicable, their contact data

You may have the option of using the chat, question or survey functions in an "online meeting". In this case, the text entries made by participants are processed in order to display them in the "online meeting" and, if necessary, to log them. In order to enable the display of video and the playback of audio, the data from the microphone of the participants' devices and from any video camera of the device are processed accordingly for the duration of the meeting. You can switch off or mute the camera or microphone yourself at any time via the applications.

The legal basis for the above-mentioned data processing is

  • with regard to the processing of personal data of students, Art. 6(1)(1)(e), (3) GDPR, Sections 3, 111(1), (5) of the Hamburg Higher Education Act (HmbHG),
  • with regard to the processing of personal data of teaching staff and employees of the university administration, Art. 6(1)(1)(e), (3), Art. 88 GDPR, Section 10(1), (2) of the Hamburg Data Protection Act (HmbDSG), and
  • with regard to the processing of personal data of external participants, consent pursuant to Art. 6(1)(1)(a) GDPR.

If you are registered as a user with the "provider", further data about "online meetings" (meeting metadata, telephone dial-in data, questions and answers in webinars, survey function in webinars) may be stored.

For the scope of data processing, please refer to the provider's privacy notices. These can be found at

b) To whom data are disclosed (categories of recipients)

Personal data processed in connection with participation in "online meetings" are generally not passed on to third parties unless they are specifically intended for such disclosure. In the course of participating in "online meetings", which are intended precisely for the exchange of content, data are of course passed on to the participants or the intended recipients to that extent. Within our organisation, only those persons who need the data for organising or conducting the meeting process the data.

Other recipients:

The provider necessarily obtains knowledge of the above-mentioned data insofar as this is provided for under the "Microsoft Terms of Use". These were displayed to you when you installed Teams; you can read them at any time at https://www.microsoft.com/licensing/terms/welcome/welcomepage .

c) Duration of data storage/erasure

We generally erase personal data when there is no need for further storage. A need may exist in particular if the data are still required to fulfil contractual services. In the case of statutory retention obligations, erasure is only possible after expiry of the respective retention obligation. Chat logs and recorded lectures are erased after the end of a calendar year.

Data transfer to third countries

NBS Northern Business School does not, as a rule, process data outside the European Union (EU), as we have restricted our storage location to data centres in the European Union.

However, we cannot rule out that data may be routed via Internet servers located outside the EU. This may be the case in particular if participants in "online meetings" are located in a third country. However, these data are encrypted during transport over the Internet and are thus protected against unauthorised access by third parties.

The parent company of the service provider, Microsoft Corporation, is based in the USA. Processing of personal data in a third country can therefore not be completely ruled out. Microsoft Corporation is certified under the EU-US Data Privacy Framework (adequacy decision of the European Commission, Art. 45 GDPR).

d) Further mandatory information (e.g. data subject rights, right to lodge a complaint) Your rights as a data subject

Under the General Data Protection Regulation, every person affected by data processing has in particular the following rights:

  • Right of access to the personal data stored about them and their processing (Art. 15 GDPR).
  • Right to rectification if data concerning them are inaccurate or incomplete (Art. 16 GDPR).
  • Right to erasure of the data stored about them if one of the conditions of Art. 17 GDPR applies. Art. 17(3) GDPR contains exceptions to the right to erasure for exercising the right of freedom of expression and information, for compliance with legal retention obligations, for reasons of public interest in the area of public health, for archiving purposes in the public interest, scientific, historical and statistical purposes, and for the enforcement of legal claims.
  • Right to restriction of processing, in particular where the accuracy of the data is contested, for the period of verifying their accuracy; where the data are processed unlawfully but the data subject requests restriction of processing instead of erasure; where the data subject needs the data for the establishment or exercise of legal claims or for defence against such claims and the data therefore cannot be erased; or where, following an objection pursuant to Art. 21(1), it has not yet been established whether the legitimate interests of the controller override those of the data subject (Art. 18 GDPR).
  • Right to object to the processing of personal data on personal grounds, insofar as there is no compelling public interest in the processing which overrides the interests, rights and freedoms of the data subject, or the processing serves the establishment, exercise or defence of legal claims (Art. 21 GDPR).
  • Right to data portability (Art. 20 GDPR)

e) Right to lodge a complaint (pursuant to Art. 77 GDPR)

Every data subject has the right to lodge a complaint with the Hamburg Commissioner for Data Protection and Freedom of Information if he or she considers that his or her personal data are being processed unlawfully. You can exercise these rights (d) and e)) via any of the communication channels we offer as stated above (see, inter alia, contact details of the controller and/or the company data protection officer).

Data protection information for recording online meetings and webinars via Microsoft Teams

Below, we would like to inform you about the processing of personal/personally identifiable data in connection with our use of "Microsoft Teams" (hereinafter "provider") and the possibility of recording, for example, events.

Prior to the information below, we would like to point out the following:

If you have not consented to the use of TEAMS, you cannot use TEAMS and consequently cannot record, for example, online courses via TEAMS.
As soon as you start a recording, all participants present and joining an "online meeting" (e.g. events) are informed of the recording of this meeting as follows, or are to be informed accordingly by you:

  • automatically by a notification line at the top of the screen:
    "Mr/Ms … has started recording"

and

  • by the lecturer/speaker by means of a written notice about the recording of the lecture at the beginning of the chat:
"Dear participants, please note that this lecture will be recorded. If you do not wish to take part in a recording, you have the option of actively logging out of this lecture. You can view the recording itself after the meeting" (for the exclusive use of assigned participants; stored in OneDrive or SharePoint)

and

  • by the lecturer/speaker by means of a verbal notice at the beginning of the lecture:
"Dear participants, please note that this lecture will be recorded. If you do not wish to take part in a recording, you have the option of actively logging out of this lecture. You can view the recording itself after the meeting" (for the exclusive use of assigned participants; stored in OneDrive or SharePoint)

Consent to recording in TEAMS, once given, can be withdrawn at any time by the respective participants through their own action (independently logging out of the respective "online meeting").

PLEASE NOTE:
Participants are strictly prohibited from forwarding and/or publishing such recordings (e.g. on social media).

a) What data we process, for what purposes we process your data, and on what legal basis:

We use a "conference tool" (hereinafter "service") to conduct telephone conferences, online meetings, video conferences and/or events/information events (hereinafter: "online meetings").

If necessary for the purpose of recording the results of an online meeting, we will log the chat content.

No automated decision-making within the meaning of Art. 22 GDPR takes place.

The following personal/personally identifiable data are subject to processing when conducting/recording "online meetings":

In order to participate in/start or record an "online meeting", you must be assigned to this "online meeting"/be appointed as "administrator" for this meeting and then provide the minimum information required for this.

When you start a recording, the participants are informed of a planned/ongoing recording of the lecture by an automated notification line at the top of the meeting screen. In addition, the lecturers should draw the participants' attention to the start of the recording by means of corresponding information at the beginning of the chat and verbally.

If participants do not consent to the recording, they have the option of actively and independently logging out of the meeting. However, all participants retain the option of accessing the recording later (for the exclusive use of assigned participants; stored in OneDrive or SharePoint). Recordings are stored in a protected manner so that only authorised persons (i.e. the group of participants assigned to this meeting) have access to the recording.

If you use the chat, question or survey functions in an "online meeting", your text entries are also processed in order to display them in the "online meeting" and, if necessary, to log them. In order to enable the display of video and the playback of audio, the data from the microphone and from any video camera are processed accordingly for the duration of the meeting. Participants can switch off or mute the camera or microphone themselves at any time via the applications.

The legal basis for the above-mentioned data processing is

  • with regard to the processing of personal data of participants, Art.

These can be found at https://privacy.microsoft.com/en-us/privacystatement

b) To whom data are disclosed (categories of recipients):

Personal/personally identifiable data processed in connection with participation in/conducting/recording "online meetings" are generally not passed on to third parties unless they are specifically intended for such disclosure. In the course of participating in/conducting/recording "online meetings", which are intended precisely for the exchange of content, data are of course passed on to the participants or the intended recipients to that extent. Within our organisation, only those persons who need the data for organising or conducting the meeting process the data.

Other recipients:
The provider necessarily obtains knowledge of the above-mentioned data insofar as this is provided for under our data processing agreement with the provider.

c) Duration of data storage/erasure:

We generally erase personal/personally identifiable data when there is no need for further storage. A need may exist in particular if the data are still required to fulfil contractual services. In the case of statutory retention obligations, erasure is only possible after expiry of the respective retention obligation.

Chat logs and any recorded events are erased after the end of a calendar year.

d) Data transfer to third countries:

NBS Northern Business School does not, as a rule, process data outside the European Union (EU), as we have restricted our storage location to data centres in the European Union.

However, we cannot rule out that data may be routed via Internet servers located outside the EU. This may be the case in particular if participants in an "online meeting" are located in a third country.

However, the data are encrypted during transport over the Internet and are thus protected against unauthorised access by third parties.

The parent company of the service provider, Microsoft Corporation, is based in the USA. Processing of personal data in a third country can therefore not be completely ruled out. Microsoft Corporation is certified under the EU-US Data Privacy Framework (adequacy decision of the European Commission, Art. 45 GDPR). We have concluded a data processing agreement with the provider that meets the requirements of Art. 28 GDPR.

e) Further mandatory information (e.g. data subject rights, right to lodge a complaint)

Your rights as a data subject

20 GDPR)

f) Right to lodge a complaint (pursuant to Art. 77 GDPR)

Every data subject has the right to lodge a complaint with the Hamburg Commissioner for Data Protection and Freedom of Information if he or she considers that his or her personal data are being processed unlawfully.

You can exercise these rights (e) and f)) via any of the communication channels we offer as stated above (see, inter alia, contact details of the controller and/or the company data protection officer).

Data protection provisions about the application and use of Brevo

We use Brevo to send newsletters. The provider is Brevo GmbH, Köpenicker Straße 126, 10179 Berlin, Germany. Brevo is a service which can be used, among other things, to organise and analyse the sending of newsletters. The data you enter for the purpose of subscribing to the newsletter are stored on Brevo's servers in Germany. If you do not want any analysis by Brevo, you must unsubscribe from the newsletter.

If you would like to receive the newsletter offered on the website, we need an e-mail address from you. Further data are only collected on a voluntary basis. We use these data exclusively for sending the requested information and do not pass them on to third parties.

When you subscribe to our newsletter, we use the so-called double opt-in procedure. This means that after you register, we send you an e-mail to the e-mail address you provided, asking you to confirm that you wish to receive the newsletter.

If you do not confirm your registration within 2 weeks, your data will be blocked and automatically erased after one month. In addition, we store the IP address you used and the times of registration and confirmation.

Your data are processed exclusively on the basis of your consent (Art. 6(1)(a) GDPR). You can withdraw your consent at any time with effect for the future via the "unsubscribe" link in the newsletter.

The data stored by us for the purpose of subscribing to the newsletter will be erased when you unsubscribe from the newsletter or withdraw your consent in any other way. Data stored by us for other purposes remain unaffected by this.

With the help of Brevo, we are able to analyse our newsletter campaigns. For example, we can see whether a newsletter message was opened and which links, if any, were clicked. In this way, we can determine, among other things, which links were clicked particularly often.

Brevo also enables us to divide the newsletter recipients into different categories ("clustering"). For example, newsletter recipients can be divided by age, gender or place of residence. In this way, the newsletters can be better tailored to the respective target groups.

We also use the Brevo Tracker, which makes it possible to track via Brevo all pages of our website visited by our contacts in order to optimise e-mail marketing automation.

You can prevent the activation of the Brevo Tracker by means of our cookie banner, or object to its activation.

Data protection provisions about the use of Facebook Pixel, Facebook Custom Audiences and Facebook Conversion

Within our online offering, the so-called "Facebook pixel" of the social network Facebook is used, which is operated by Meta Platforms, Inc., 1 Hacker Way, Menlo Park, CA 94025, USA, or, if the user is resident in the EU, by Meta Platforms Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland ("Facebook"). Insofar as data are transferred to Meta Platforms, Inc. in the USA, this is based on the EU-US Data Privacy Framework, under which Meta is certified (adequacy decision of the European Commission, Art. 45 GDPR).

With the help of the Facebook pixel, Facebook is able, on the one hand, to determine visitors to our online offering as a target group for the display of ads (so-called "Facebook ads"). Accordingly, we use the Facebook pixel to display the Facebook ads we place only to those Facebook users who have shown an interest in our online offering or who have certain characteristics (e.g. interests in certain topics or products, determined on the basis of the websites visited) which we transmit to Facebook (so-called "Custom Audiences"). With the help of the Facebook pixel, we also want to ensure that our Facebook ads correspond to the potential interest of users and are not perceived as intrusive. With the help of the Facebook pixel, we can furthermore track the effectiveness of the Facebook ads for statistical and market research purposes by seeing whether users were redirected to our website after clicking on a Facebook ad (so-called "conversion").

  • Facebook privacy policy
The processing of data by Facebook takes place within the framework of Facebook's data use policy. Accordingly, general information on the display of Facebook ads can be found in the Facebook data policy. Specific information and details about the Facebook pixel and how it works can be found in the Facebook help section.
  • Legal basis
The use of the Facebook pixel and the storage of "conversion cookies" are based on Art. 6(1)(a) GDPR.
  • Objection
You can object to the collection by the Facebook pixel and the use of your data to display Facebook ads. To set which types of ads are displayed within Facebook, you can call up the page set up by Facebook and follow the instructions on the settings for usage-based advertising. The settings are platform-independent, i.e. they are applied to all devices, such as desktop computers or mobile devices. You can also object to the use of cookies for reach measurement and advertising purposes via the opt-out page of the Network Advertising Initiative and additionally via the US website aboutads.info or the European website youronlinechoices.com. A further opt-out option can be found in our cookie declaration.

The processing of the data is strictly bound to the purposes pursued with the respective Lead Ad campaign. Depending on the focus of the Lead Ad campaign, the legal basis for data processing is either your express consent (for example for direct marketing measures such as registration for the e-mail newsletter (in our case via Brevo)) or our legitimate interest in optimally marketing our offering. The data are not passed on to third parties.

In the context of the aforementioned services, data transmitted via instant forms may be stored on servers of Meta Platforms, Inc., 1 Hacker Way, Menlo Park, CA 94025, USA. Application and use of LinkedIn Lead Gen Forms (Lead Ads)

NBS Northern Business School gGmbH uses advertisements on the LinkedIn platform in the format LinkedIn Lead Gen Forms (hereinafter: "LinkedIn Lead Ads"). The provider is LinkedIn Ireland Unlimited Company, Wilton Plaza, Wilton Place, Dublin 2, Ireland (for users resident in the European Economic Area and Switzerland).

Purpose of processing

LinkedIn Lead Ads enable us to deliver targeted advertisements on LinkedIn to prospective students, through which a pre-filled contact form within the LinkedIn platform can be opened directly. The data collected are used for study advice, for sending information material and for contacting the person in the course of the application process.

Data processed

When LinkedIn Lead Ads are used, the following personal data are processed, insofar as they are requested in the form:

  • First name and surname
  • E-mail address
  • Telephone number
  • Other information provided by the user (e.g. study interest)

At the user's request, LinkedIn pre-fills the form with the data stored in the LinkedIn profile. The data are only finally transmitted once the user actively confirms.

In addition, as part of its advertising service, LinkedIn processes its own data for the delivery, optimisation and performance measurement of the ads (e.g. impressions, click rates). These data are made available to us exclusively in aggregated, anonymised form as campaign statistics.

Legal basis

The personal data submitted in the form are processed on the basis of the data subject's consent pursuant to Art. 6(1)(1)(a) GDPR, which is given by actively submitting the form.

The delivery of advertisements on LinkedIn and the associated reach measurement are based on our legitimate interest in target-group-oriented communication on the higher education market pursuant to Art. 6(1)(1)(f) GDPR.

Joint controllership

For the processing of personal data in the context of ad delivery and the use of LinkedIn Insights tools, NBS Northern Business School gGmbH and LinkedIn are joint controllers within the meaning of Art. 26 GDPR. This is based on LinkedIn's "Page Insights Joint Controller Addendum". The primary point of contact for data subject rights with regard to the data processed by LinkedIn Ireland itself is LinkedIn Ireland Unlimited Company.

Transfer to third countries

LinkedIn Ireland may transfer data to affiliated companies, in particular to LinkedIn Corporation, based in Sunnyvale, California, USA. The transfer is based on the EU standard contractual clauses pursuant to Art. 46(2)(c) GDPR.

Storage period

The contact data transmitted via LinkedIn Lead Ads are stored by NBS Northern Business School gGmbH for as long as an active study advice relationship exists or until the data subject objects to further processing or withdraws his or her consent. The data are then erased, unless statutory retention obligations prevent this.

Legal basis and purpose of the processing

Art. 6(1)(a) GDPR serves as the legal basis for processing operations for which we obtain consent for a specific processing purpose. If the processing of personal data is necessary for the performance of a contract to which the data subject is party, as is the case, for example, when processing operations are necessary for the supply of goods or the provision of any other service or consideration, the processing is based on Art. 6(1)(b) GDPR. The same applies to such processing operations which are necessary for carrying out pre-contractual measures, for example in the case of enquiries concerning our products or services. If our institution is subject to a legal obligation by which processing of personal data is required, such as for the fulfilment of tax obligations, the processing is based on Art. 6(1)(c) GDPR. In rare cases, the processing of personal data may be necessary to protect the vital interests of the data subject or of another natural person. This would be the case, for example, if a visitor were injured on our premises and his or her name, age, health insurance data or other vital information had to be passed on to a doctor, hospital or other third party. The processing would then be based on Art. 6(1)(d) GDPR. Finally, processing operations could be based on Art. 6(1)(f) GDPR. This legal basis is used for processing operations which are not covered by any of the abovementioned legal grounds, if processing is necessary for the purposes of the legitimate interests pursued by our institution or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject. Such processing operations are particularly permissible because they have been specifically mentioned by the European legislator. He considered that a legitimate interest could be assumed if the data subject is a client of the controller (Recital 47 Sentence 2 GDPR).

Legitimate interests pursued by the controller or by a third party

Where the processing of personal data is based on Article 6(1)(f) GDPR, our legitimate interest is to carry out our business in favour of the well-being of all our employees and our shareholders.

Period for which the personal data will be stored

The criterion used to determine the period of storage of personal data is the respective statutory retention period. After expiry of that period, the corresponding data are routinely erased, as long as they are no longer necessary for the fulfilment or initiation of a contract.

Statutory or contractual requirements for the provision of personal data

Requirement necessary to enter into a contract; obligation of the data subject to provide the personal data; possible consequences of failure to provide such data

We would like to clarify that the provision of personal data is partly required by law (e.g. tax regulations) or can also result from contractual provisions (e.g. information on the contractual partner). Sometimes it may be necessary to conclude a contract that the data subject provides us with personal data, which must subsequently be processed by us. The data subject is, for example, obliged to provide us with personal data when our institution concludes a contract with him or her. The non-provision of the personal data would have the consequence that the contract with the data subject could not be concluded. Before personal data are provided by the data subject, the data subject must contact one of our employees. Our employee will clarify to the data subject, on a case-by-case basis, whether the provision of the personal data is required by law or contract or is necessary for the conclusion of the contract, whether there is an obligation to provide the personal data, and what the consequences of non-provision of the personal data would be.
